Welcome to THEDOGSQUAD (‘website’).
This website provides a community for Rugby League fans, with a primary focus on the Canterbury-Bankstown Bulldogs club (including but not limited to its players, board, development, and history).
This document has been produced following legal advice current as of 2020 under NSW and Federal Legislated Acts.

Privacy:

THEDOGSQUAD takes your privacy seriously and any information provided through your use of the website and/or content are subject to THEDOGSQUAD Privacy Policy, which is available on the website in the same location as Terms of Use.

THEDOGSQUAD offers a messaging system between users called “Conversations”. Please be aware that whilst conversations are between private parties, no insurance or inferences are made that the messages sent under “conversations” are completely private.

In order to comply with the legal obligations of this website, we may be required to provide copies of your “conversations”, by way of exporting from the website database. We stipulate that the only time that these messages will be accessed, is when required and requested by a legitimate law enforcement agency to assist with investigations, or by way of complying with a legal subpoena filed in a NSW Court of Law.

General Disclaimer:

THEDOGSQUAD will not be liable for any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the content or these Terms (including as a result of not being able to use the content or the late supply of the content), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

Limitation of liability:

2. You acknowledge and agree that THEDOGSQUAD holds no liability for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you as a result of providing your content to the website.

To the maximum extent permitted by law, we are not responsible for any loss, damage or expense, howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent (Liability) suffered by you or any third party, arising from or in connection with your use of our website and/or the content and/or any inaccessibility of, interruption to or outage of our website and/or any loss or corruption of data and/or the fact that the content is incorrect, incomplete or out-of-date.

The owners, admin, staff, and sponsors will in no way be held liable for any comments (made, stated or construed) on this forum. Termination of Contract:

1. THEDOGSQUAD may at any time, terminate the Terms with you if:
(a) you have breached any provision of the Terms or intend to breach any provision;
(b) THEDOGSQUAD is required to do so by law;
(c) THEDOGSQUAD is transitioning to no longer providing access to Members in the country in which you are resident or from which you use the service; or
(d) the provision of the Services to you by THEDOGSQUAD, is in the opinion of THEDOGSQUAD, no longer commercially viable; or
e) you are considered a nuisance to the site, and it is in the best interests of the site to terminate your access.

2. Subject to local applicable laws, THEDOGSQUAD reserves the right to discontinue or cancel your access at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the website without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts THEDOGSQUAD name or reputation or violates the rights of those of another party.

3. When the Terms come to an end, all of the legal rights, obligations and liabilities that you and THEDOGSQUAD have benefitted from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of this clause shall continue to apply to such rights, obligations and liabilities indefinitely.

Indemnity:

You agree to indemnify THEDOGSQUAD, its owners, administrators, moderators, users, sponsors and affiliates from and against:
(a) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your content;
(b) any direct or indirect consequences of you accessing, using or transacting on the website or attempts to do so; and/or
(c) any breach of the Terms.

To the maximum extent permitted by law, you must indemnify us, and hold us harmless, against any Liability suffered or incurred by us arising from or in connection with your use of our website or any breach of these Terms or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and continues after these Terms end.  It is not necessary for us to suffer or incur any Liability before enforcing a right of indemnity under these Terms.

Dispute Resolution:

No dispute may arise out of or in relation to the Terms. By participating on this website you are agreeing to everything in these terms. The owner and administrators decision is final in relation to the right to participate (and termination of participation) on this website.

Discontinuance:

We may, at any time and without notice to you, discontinue our website, in whole or in part.  We may also exclude any person from using our website, at any time and at our sole discretion. We are not responsible for any Liability you may suffer arising from or in connection with any such discontinuance or exclusion.

Jurisdiction:

Your use of our website and these Terms are governed by the laws of New South Wales, Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New South Wales, Australia and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.

In the event of any dispute arising out of or in relation to the website, you agree that the exclusive venue for resolving any dispute shall be in the courts of New South Wales, Australia.

Our website may be accessed throughout Australia and overseas.  We make no representation that our website complies with the laws (including intellectual property laws) of any country outside Australia.  If you access our website from outside Australia, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our website.

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
